I. Application of These Terms And Conditions

This website is operated by Yoga Movement PTE LTD ("YM", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your relationship with YM, including, but not limited to, your use of the YM Website www.yogamovement.com (the "Website") and the YM Mobile Application (the "App"), your purchase of YM classes, your registration for classes, your purchase of merchandise, your communication with YM, and your use of and attendance at YM's studios. Please read through all Terms carefully and approach our team should you have any questions!

II. Class Bookings

You can make a reservation at YM without having a valid single class or a class pack. You will need to sign up to YM to make this reservation and can do so by selecting your intended class in the schedule (www.yogamovement.com/schedule) and by using your e-mail and creating a password. If you are completely new to YM, all information that you will need can be found here www.yogamovement.com/newbies. If you are already a registered YM’er, fill out your Username and Password to make your reservation via the class schedule. You can also make class bookings by calling or emailing the studios.

You can reserve classes online up to one (1) week in advance (Monday at noon through the following Monday), and you are able to “Walk-In” to classes with available space. We highly recommend that you plan to be at the studio 20 minutes before the class start time, to allow for any travel challenges, and simply to give yourself the time to get checked in and be “yoga ready”.

III. Cancellation Policy for Booked Classes

You are able to cancel your class booking without any charges or loss of classes from your Class Pack up until two (2) hours before the class start time. Should you not cancel class before this time, or simply not show for the class, a class will be deducted from your active class package or single class purchase.

You can cancel your reservation in the following ways:

1. Log into your account on the Website or the App, select “Schedule” next to the class you have booked, and click “cancel”.

2. Call the studio where you're booked to cancel the class for you. Emails may not reach in time, so it’s always best to call to confirm your cancellation.

FOR YM CLIENTS THAT ARE RUNNING LATE FOR CLASS: If you are running late for your booked class, we ask that you call the studio to let us know you are on the way. The front desk will hold a booking only until the class begins.

If it’s a busy period and the class is waitlisted, the Front Desk will have the right to give your mat to walk-ins that have made it to class on time. This can and will be done at the complete discretion of the YM Team. Clients who are late will not be admitted into class as it is too disruptive for both the teacher and other YM’ers.

FOR YM CLIENTS INTENDING TO LEAVE EARLY: If you're planning on leaving early, we kindly request that you tell the teacher ahead of time. It is always discouraged, as we don’t want your early departure to be off-putting to the teacher or other YM clients.

IV. Classes and Class Packs for Individuals/Rollovers/Extensions

Purchases of Classes or Class Packs can only be made in studio. We accept MasterCard, Visa, Nets, and Cash payments. You can view all Class and Class Pack Prices on our Yoga Menu at www.yogamovement.com/classes/prices. Your Class Pack will initiate on the date of purchase.

Purchased classes are only for the individual that purchased the classes. You cannot give classes to another as a gift. When you buy a class, you are only entitled to use that class to book a class in a particular studio at a particular time. You cannot redeem your class for cash and you cannot transfer it to another person or YM member. YM does not allow on-selling of Classes or Class Packs. Any Class or Class Pack that has been purchased anywhere other than YM will not be honoured.

Classes do expire. The expiration dates of your class packs can be found in the My Account section of the website. The validity will also be clearly stated on your Class Pack purchase receipt. These validities do vary based on Class Pack size. Promotional Class Packs may also carry different validity periods.

We will send an email notification to the address assigned to your profile a month before the expiration of your package.  If, however, you cannot finish your classes within the allotted validity period, YM will allow up to two (2) validity extensions of up to one (1) month per extension, per package. These extensions must happen when the package is still active and will not be possible should the package expire.

Should your class pack expire, we do allow rollover of expired classes in to a newly purchased class pack. This must happen within six (6) months of the expiry of the original package. The validity of the rolled over classes will be in line with the stated validity of the newly purchased pack. You cannot extend rolled over classes, and you cannot roll over rolled over classes. Classes that have expired cannot be rolled over into a single class purchase, rollovers are only applicable to new class pack purchases.

If you fall pregnant within your Class Pack validity, you will be entitled to a one time freeze of your package validity of up to 12 months.

Future class prices are subject to change, however, YM will honour your class or series of classes until the expiration date, regardless of whether there is a price adjustment in the interim.

V. Classes and Class Packs for Groups (Shareable Packs)/Rollovers/Extensions

Purchases of Group Class Packs, that can be shared, can only be made in studio. We accept MasterCard, Visa, Nets, and Cash payments. You can view all Class and Class Pack Prices on our Yoga Menu at www.yogamovement.com/classes/prices. Your Class Pack will initiate on the date of purchase.

Classes do expire. The validity will also be clearly stated on your class pack purchase receipt. These validities do vary based on Class Pack size. Group Promotional Class Packs may also carry different validity periods. We will send an email notification to the address assigned to your group profile a month before the expiration of your package.  There are no extensions of Shareable Group Packages, nor are there any package rollovers. Please consider your sharing partners carefully, as YM will not facilitate any negotiation of disputes between Group Pack members. YM does not allow on-selling of Shareable Class Packs. Any Class or Class Pack that has been purchased anywhere other than YM will not be honoured.

Future class prices are subject to change, but YM will honour your class or series of classes until the expiration date, regardless of whether there is a price adjustment in the interim.

All class pack purchases (individual or shareable) are final and non-refundable.

VI. Special Circumstances and Right to Transfer

We do understand the challenges of significant life events that may be out of your control. You or your representative may transfer your purchased Class Pack, strictly before the expiration date, for any of the reasons listed below. To do so, you must give us written notice, by e-mail, to info@yogamovement.com or Yoga Movement PTE LTD, #02-01, 11 Upper Circular Road, Singapore, 058409. Attention: THEYMFAM.

You may transfer your class pack in any of the following circumstances;

·       If you become disabled and, as a result, cannot physically participate in a class you have purchased, and your condition is verified by a doctor. The package will retain its validity and remainder classes, as well as attract a transfer fee of 20% of the original package price.

·       If you move outside of Singapore, you may transfer your purchase to another YM client, or a Newbie. The package will retain its validity and remainder classes, as well as attract a transfer fee of 20% of the original package price.

VII. Geographic Use of Classes

YM offers different class packs so that our clients can select the options that best suit their individual needs. Before you buy a class pack, it is important that you take a minute and read the written descriptions we provide you about what the class pack includes, its expiration date, and any limitations on where you may use your class.

VIII. Retail and Merchandise

Yoga Movement offers vertically branded product in studio, as well as varied external brands. Any product that is purchased may be exchanged within seven (7) days of the initial purchase, as long as the product is unused, unsoiled, and has all tagging intact. Refunds on full price items are not available.

YM will occasionally, at its own discretion, conduct sales on YM Merchandise and other product. All sales on discounted product are final. Exchanges and refunds are not offered on sale product.

IX. Gift Vouchers

In addition to classes and class packs, you can also buy YM gift vouchers. Gift vouchers expire six (6) months after purchase, and the person that you are giving them to can use his or her gift voucher(s) to buy classes or any kind of merchandise. Once a purchase is made using a gift card, it will expire, just like any other class you buy. If you would like to buy a gift voucher, you can do so in person at any of our studios www.yogamovement.com/studios.

X. Lost or Damaged Personal Property

Each YM studio provides lockers to house your personal goods when class is in session. YM also maintains CCTV at all studio common areas. Regardless of care taken to avoid loss, YM is not liable or responsible for any damage, theft, loss, or destruction of personal property within the YM Studios.

XI. Waiver and Release

By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment (individually and/or collectively, the "Classes and Facilities") of YM, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in practicing yoga at YM. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries and that YM and the YM Team will not be liable for any injury or damage should you choose to participate.

If in the subjective opinion of the YM staff, you and/or others would be at physical risk using YM's Classes and Facilities, you understand and agree that you may be denied access to the Classes and Facilities.

XII. Dispute Resolution

At YM, we do our best to make sure you have a great experience every time. Whenever someone purchases a YM class pack, we feel indebted to that individual by way of excellent service. We do acknowledge that from time to time, our expectations don’t align. Should this happen, we hope you will give us the opportunity to try to address any challenge you may be facing at YM. Please include: (1) your name, (2) your address, (3) a description of your concerns, and (4) a description of the specific relief you seek.

XIII. Links/Third Party Websites

YM has not reviewed all the sites linked to the Website and/or App, and is not responsible for the content or any off-site pages or other linked sites. Although a third-party website and/or app may contain the YM logo, please understand that it is independent from YM, and that YM has no control over the content of that website and/or app. Going to third party or off-site websites from the Website and/or App is at your own risk. These links do not imply endorsement of, sponsorship of, or affiliation with YM.

XIV. Intellectual Property Rights

The trademarks of YM are proprietary to YM and may not be used by you for any reasons other than as expressly permitted by these Terms. All Website and App content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, YM. You have the right to view, electronically copy, and print in hard copy portions of the Website and App for the sole purpose of making class reservations, purchases, or other personal use.

Any other use of materials on the Website, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of YM, is strictly prohibited.

You acknowledge that YM and/or third-party content providers remain the owners of all Website and App materials, and that you do not acquire any of those ownership rights by downloading, copying, or using any such material in accordance with these Terms. YM may discontinue or remove the Website or App, or any portion thereof, or discontinue your right to use the Website or App, or any portion thereof, at any time.

XV. Use of the Site and Studios by Minors

If you are under 18, you may use the Website and App only with the involvement of a parent or guardian. Registration of a minor is permitted for YM classes only, and must be completed in person at one of our studios with a parent or guardian, and the minor must be over 16 years of age.

XVI. Warranty Disclaimer and Limitation of Liability

In no event will YM be liable for any direct, indirect, special, or other consequential damages resulting from your use of the Website, the App, or on any other linked/third-party website, your purchase of YM classes, your booking of classes, your purchase of merchandise, your communication with YM, and your use of and attendance at YM's studios, including without limitation, any lost profits, business interruption, loss of programs, or other data on your information handling systems or otherwise, including any claims waived by you previously in this agreement even if YM expressly advised of the possibility of such damage.

All information, goods, services, products and experiences are provided by YM on an "as-is" basis only. The entire risk as to the quality and performance of the goods, services, products and experiences remains with you. Should the goods, services, products and/or experiences prove defective after purchase, you assume the entire cost of such defect. YM provides no representations and warranties, express or implied, including the implied warranties of fitness for a particular purpose, merchantability, and non-infringement.

XVII. Choice of Law

The Terms are governed by the laws of Singapore.

XVIII. Acceptance of Terms

By using the Website or App, purchasing a YM class, booking a YM class, purchasing merchandise, and/or using or attending a YM class, you signify your acceptance of the Terms. If you do not agree to this, please refrain from using the Website or App, purchasing a YM class, booking a YM class, and/or using or attending a YM class.

Occasional changes may be made to this document to reflect changes in YM's policies. The Terms may be revised at any time by updating this posting. By using the Website or App, by buying YM classes, booking classes, buying merchandise, and/or using and attending YM's studios, you agree to be bound by any such revisions. YM clients are encouraged to check this document periodically to stay informed of current guidelines.

XX. Legacy Terms and Conditions
